We've had a sneak preview and the entrees comments about the US underwriting many of the horrible things we've been talking about emanating from communist China at the moment.

I'm very pleased to have my colleague friend Roger Robinson, former Senior Director for International Economic Affairs at the Reagan National Security Council. One of the men who helped President Reagan translate the 1970s version of the Committee on the present danger into a strategy for taking down the USSR and we're pleased to have him come back to talk a little bit more about a case study of how American investors are unwittingly enabling the sort of police state apparatus. Launch out and also talked about, and talked to us about Hikvision Roger Robinson.

He is these days among other things chairing the Prague Security Studies Institute and I believe it's in that capacity that you're here.

I am,and what's our time table?
Excellent, I will observe for once.

Well it's a as always a privilege to have a chance to speak to you today as Frank knows and the committee has rather fulsomely explored this rather new topic of the Chinese corporate presence in the US capital markets.

And to the surprise of many we're not talking about small change. We're talking about hundreds of billions of dollars, of often times high risks what folks would I think even me immediately conclude our Chinese bad actors from the perspective of national security and human rights abuses, that have successfully entered our markets and in so doing the portfolio's of average Americans including those in the room..

Now it's not just a few Americans, I don't know how many Americans totallin the markets. Maybe 180 200 million if I took a rough a rough guess. So we're talking about the bulk of the population of the United States and as you may also guess not having heard much about this subject if anything in the past it tells you it should tell you that there's been no security minded or human rights minded screening mechanism ever put up over the capital markets of the United States, despite the fact that our markets are roughly the size of the rest of the world's combined.

Now I wouldn't be surprised if China has one trillion dollars in exposure in our markets. It's a very difficult subject to research. We've been at it for a couple of years and I feel that even now we're just at the biopsy stage of trying to understand this pathology because make no mistake these are not necessarily benign entities. They are they are ones that we would be concerned about. For example we talked about Hikvision.

Obviously they are of one of the worlds if not the world's leading provider of surveillance cameras that are littering the tops of the walls of the concentration camps housing one two or more million Uyghurs. This is something I'd like to come back to because we are finally getting action in that portfolio having highlighted the fact that Americans are unwittingly aiding and abetting the concentration camp business which is something that I think we'd all be loath to see as using our hard-earned investment dollars whether our retirement systems or one of other many funds from index funds to exchange-traded funds mutual funds, it's a long list and it's faceless fund managers that we all myself included turn our funds over and hope that they'll do the right thing. Well they may be going for return but they're not going for values and they're not going for moral compass that's what I'll assure you of today.

Illustrations: China Unicom sounds benign enough listed on the New York stock exchange. No less a serial PLA contractor they provide the telecom services to the Chinese military in the South China Sea including its signal intelligence facilities they provide North Korea with its only internet service.

That should tell you something they are the entity that provided the wherewithal for the pla s most aggressive cyber attack unit, apt one to hack into hundreds of American companies and steal our competitive information so that their state-owned enterprises of China would be able to be even more assured than they already are of taking these contracts so that is a small profile of MSCI and we're still there in the MSCI Emerging market index, I was sorry I was meant Hikvision now, we're talking about.

Besides being on the New York Stock Exchange it's also in the MSCI Emerging market index. That index is tracked by 16 trillion dollars of funds under management. So when a Chinese company is added to an index fund, automatically that 16 trillion dollars buys that stock. Now think of the windfall for China and think of the fact that that company goes into every otherwise healthy cell of the American body politic. That's what you call going viral instantly and they're not alone in the MSCI. If you look at other entities that have found this promised land for China. This very efficient way of entering the portfolio's of the American people in one shot, look at other participants Avik aircraft that sounds innocent enough.

What do they do? Well, they produce a range of fighter aircraft and unmanned aerial vehicles. They're responsible for China's anti-ship missiles deployed in the South China Sea. They've been sanctioned several times but you're not going to read about that. In the prospectus that they're submitting to the SEC supposedly recording material risk so that all of us are properly informed before we make an investment decision. You don't see these types of profiles appear there despite again the materiality of that risk to share value and corporate reputation. I mean even if we put moral compass and our national security concerns aside we still have the fact that these are fundamental market violations where every all of us need to disclose our risks properly and yet the Chinese get a free pass in not doing so.

More recently Avik has provided Iran's new ground-based anti-ship cruise missiles which may be readied as we speak to use against American naval forces in the 6th fleet and beyond. Moving on China's shipbuilding they just build commercial ships right?? Well think again guided missile destroyers they built they build nuclear ballistic missile submarines. They're the ones that are targeting our cities. They're the ones that are targeting your families and they're the ones that are benefiting from your investment dollars as in the people in this room, much less our fellow Americans has this issue ever seen the light of day?

Do you recall anybody talking about this on Capitol Hill in the executive branch in the media in a cocktail party? You'd think that somebody would have said something by now but they didn't, did they? Now I'm talking about empirical facts here I'm not talking about my opinion versus yours on something like missile defense. So this is this should tell you something else. It tells you that the very fact that we don't know about this and that we're focused almost single mindedly on us-china trade as important as it is because this is where they live and die. This is the money this was the money with the Soviet Union that's what we went after, we went after their hard currency cash flow we went after their escape valves in Western governments and banks providing those credits. They'd be up today if Ronald Reagan had not put clamps on every one of the life-support tubes that we were providing.

And guess what here we go again. Now Hikvision I'll conclude by saying is it could be a success story.This issue has been out there for a while. The human rights community our friends at the victims of communism Memorial Foundation and others have been alert to this for a long time that they were aiding and abetting these concentration camps and the fate of this massive number of people that you can see from space.

Well but it's hard to give it expression it's hard to get critical mass attention much less action. Well we've made a breakthrough there which is we're now able to look at publicly traded Chinese companies we the presence in our capital markets who are providing the wherewithal for that facial recognition technology for those very surveillance cameras that keep them tucked away behind razor wire. Now this is this is out there, and victims of the communism and others have made it so. Now we're hearing that Hikvision maybe being readied for the entity list of the Department of Commerce where you need a license to supply any components. I mean this could be a major problem for Hikvision to say the least, you say you see what's happened to Huawei, you saw what happened to ZTE before that and I think with any luck Hikvision is going to hit the wall on that entity list.

Remembering that their parent company has already been put on the entity list because their big surprise a national security violator. Can we have more Hikvisions? Can we bring recognition to this issue once and for all? And the answer is yes we can we have the power to do this. This is our money we have a right to hold Wall Street accountable. We have a duty to do so and finally we can give expressions to our most coveted values both national security and human rights. Thank you very much

Roger, I just want to take the liberty to ask you to specifically address one question that you've talked about more elsewhere than I think you did here and that is the disparity between the way these companies from China are being treated by our Securities and Exchange Commission relative to how they treat our own companies.

What you just talked about that is another place where we sure make changes.

So this gets down to disclosure and accountability. And that's why those remedies can serve us so well in this case namely in the US or a West European country, company I'm sorry. or any of those of our allies face a rigorous test when they come to the New York Stock Exchange NASDAQ even to a lesser extent our over-the-counter market that the disclosure is fundamental as is risk management you're supposed to record any material risk to share value in corporate reputation and if you don't it's called by the SEC a material omission which is legally actionable.

So it's against the law I mean let's be clear this is not a small thing. And yet whereas we will go after an American company for a material omission but China doesn't write any of this down. They don't tell you that there in the South China Sea they don't tell you that they're underwriting North Korea and nuclear and missile capabilities. They don't tell you that they've been sanctioned before they don't tell you that their employees have been arrested for espionage. Where's that in the risk section and isn't that material to my decision as to whether or not to buy the stock?

They can be sanctioned I mean even if you put our again our values aside what about share value? What's going to happen to their corporate reputation when they show up in the front page of The Wall Street Journal or something of that kind?

So this is actually ironically evening the playing field this is preferential treatment. Now imagine the irony I mean how sickening and affair this really is.

One more question from Roger what's preventing the SEC from doing its job?
Well in part it the SEC has never been confronted with the notion that should be obvious to all of us in every American which is the materiality of national security abuses in your background or the aura in your network of subsidiaries not to mention human rights abuses like are taking place in Tibet and Vis a Vis Uyghurs.

So these are not acknowledged to be material risk categories. How convenient you know how lovely for Beijing that we just kind of give that one amiss, don't we? We were interested in corruption and we're interested in a number of other things but these two categories don't seem to make the cut and that's what we're able to change and that's where we should be headed

우리는 이미 시사회를 했고. 미국이 끔찍한 일들을 많이 하고 있다는 주요 주제에 대한 평을 했는데 공산주의 중국에서 발산되고 있는 것들에 관해서였지요. 

저의 동료이자 친구이며 레이건 국가 안보 위원회 국제 경제 담당 수석이었던 라져 로빈슨을 오늘 이처럼 함께하게 되어 아주 기쁩니다. 그는 또한 레이건 대통령이 1970년의 현존 위기 위원회를 정책화하는데 도움을 주었던 사람 중의 한 사람인데 그 정책은 소련을 무너뜨리었지요. 그가 다시 돌아와 하나의 사례 연구에 관해서 조금 더 자세히 말해 줄 수 있어서 기쁩니다. 그 사례연구란 미국의 투자자들이 어쩌다 부지불식간에 일종의 경찰국가 제도를 돕고 있는가에 대한 것이지요. 연설 시작하여 하이크비전에 관해서도 말 좀 하시게, 라져 로빈슨!.

최근에 그는 여러 다른 일들을 하는 중에도 프라하 증권 연구 위원회 회장직을 또한 맡고 있는데 오늘 이자리에 선 것은 그런 역활의 일환으로 섰다고 믿는데.

그래요, 그런데 주어진 시간이 얼마지요?
좋아요. 내 한번 시간 지켜보리다.

자, 늘 그랬듯이 오늘 여러분에게 말할 기회를 가진 것은 하나의 특권이지요. 후랭크가 잘 알고 있듯이 그리고 위원회가 어쩌면 새로운 주제인 미국 시장에 현존하는 중국기업들에 관해 지나칠 정도로 잘 살펴보았지요

많은 분이 놀라겠지만 우리는 사소한 변화를 이야기 하는 게 아니지요 . 우리는 수억 억 달러에 관해 이야기하고 있는데, 제 생각에 사람들이 금방 인지할 수 있으며 자주 일어나는 상당히 높은 수준의 위험으로, 우리가 아는 중국은 국가 안보와 인권남용의 각도에서 볼 때 여러 악역을 하고 있지요. 그들은 우리 시장 여러 곳에 성공적으로 들어왔으며 그리함으로써 이 방에 있는 분들을 포함한 보통 미국 시민의 유가 증권 일람표에도 끼어들어 있지요. 그 게 미국인들 몇 명에 국한된 게 아니지요 . 그런데 얼마나 많은 미국인이 여러 시장에 속해 있는지 전 잘 모릅니다.

제가 대략적인 추측을 한다면 아마도 1억 8천만 에서 2억. 따라서 우리는 미국 인구의 대부분에 관해서 이야기하고 있으며 여러분이 짐작하둣이 이 주제에 관해서 여러분들은 과거에 뭔가 들었다 해도 별로 아무 것도 듣지 못했을 것이지요. 그런 사실은 미국 자본 시장에는 어떠한 안보에 대한 생각이나 인권에 대한 심사 제도가 전혀 없었다는 것을 알려 주어야겠지요. 우리 시장의 크기가 거의 나머지 세계의 시장을 합친 것 만큼이나 큰데도 불구하고 말이지요..

이제 저는 중국이 우리 시장 안에 1조 달라를 노출하고 있다 해도 놀라지 않을 겁니다. 이 문제 아주 연구하기 어려운 주제지요. 우리 이 문제를 2년간 연구해 왔지만 저는 지금 우리가 이 기이한 병리학을 이해하려는 데 있어 그저 생체 검사 단계에 있을 뿐이라고 느낍니다. 왜냐면 정말이지 이들은 양성의 집단이 아니기 때문이지요, 그들은 우리가 신경 써야 할 존재들이지요. 예를 들자면 하이크비젼을 들을 수 있지요.

분명히 그들은 감시 카메라 공급자로서는 세계에서 손꼽는, 세계를 주도하는 회사 중의 하나며 그 감시 카메라들은 일백 2백 아니 수 백만 명의 위구르족을 수용하는 강제 수용소 벽 위에 지저분하게 흐트러져 있지요. 이 문제는 뒤에 가서 다시 거론해보고 싶은 문제네요. 왜냐면 마침내 우리는 미국인들이 본의 아니게 강제 수용소 일을 도우거나 사주해 왔다는 사실을 조명하였으며 그 들의 증권 열람표에 대한 조치를 하고 있기 때문이지요. 제 생각에 우리가 어렵게 번 투자금을 그런 일에 사용한다는 것은 우리 모두 증오해야 할 일이지요. 그 투자금이 우리의 연금 제도의 것이거나 지표채에서 상장 지수 펀드나 상호기금의 것이거나 상관없이. 목록이 길지만, 저를 포함한 정체불명의 자금 관리자들이 자금을 투자할 때 모든 게 잘 되기를 바라지요..그런데 그들은 투자 수익을 바라고 그리하겠지만 그들은 가치나 도덕적인 개념 같은 것을 고려하지 않지요. 그게 오늘 이 시점에서 제가 확실히 여러분에게 알려 드릴 수 있는 것이지요.

예로 중국 유니콤은 충분히 양성적으로 들리니 자그마치 뉴욕 증권시장에 상장되었지요. 연속적인 중공 인민군의 계약자로 그들은 남중국해에 있는 중공군에 전자 통신 서비스를 제공하지요. 중공군의 신호 정보 시설들을 포함해서. 그들은 북한의 유일한 인터넷 서비스를 제공하지요.

이거 여러분에게 뭔가 알려 주어야 하지요. 그들은 중공 인민군의 가장 공격적인 사이버 공격부대가 필요한 모든 수단 기술을 제공하는 기업이지요. 수백의 미국 회사를 해킹했고 우리의 경쟁적인 정보를 훔쳐낸 중국 사이버 첩보 기관인 APT1을 돕는 기업으로서.  그런 식으로 중국의 국유기업들이 이들 계약을 얻어내는 데 더 확실하게 되게끔 돕는 기업이지요. 그래 그게 MSCI (모르겐 스탠리 캐피탈 인터내셔널 ) 의 작은 증권 열람표이며 우리는 여전히 MSCI의 신흥 시장 채권지수를 말하고 있는데 .미안해요, 지금 우리가 이야기 하는 것은 하이크비젼이어요.

뉴욕 증권시장에 올려져 있을 뿐 아니라 그것은 또한 MSCI 신흥 시장 지수에도 올려져 있지요. 그런데 그 지수는 16조 달러의 펀드를 관리하는 운영진에 의해서 추적되고 있지요. 따라서 한 중국 회사가 한 인덱스 펀드 지수에 올려 지면 자동으로 16조의 달러가 해당 증권을 사고 있지요. 이제 중국이 얻는 횡재를 생각하고 그 회사가 그 이전에는 건강한 유기체였던 미국 정치조직체에 그들이 끼어 들어 가는 것을 고려해보세요. 그런게 사람들이 말하는 즉각적인 성공이라는 것인데 그런 현상은 MSCI에 국한된 것이 아니지요. 이런 중국을 위한, 이 약속의 땅을 발견해낸 다른 기업체들을 들여다보자면, 한 방에 미국인들의 증권 포트폴리오에 들어갈 수 있는 아주 효율적인 방법인데. 다른 참가자들을 살펴볼까요. 아빅비행기 아주 순진하게 들리지요.

그들이 하는 일이 무얼 가요? 그러니까, 그들은 일련의 전투기와 무인기들을 생산하지요.. 그들은 남중국해에 배치되는 중국의 대함 미사일들을 담당하고 있지요 그들은 여러 번 제재당했으나 여러분들 그런 거 읽지 못할 거지요. 저들이 증권 거래 위원회에 제출하는 투자설명서에 주요 위험요소를 기록하게 되어 있지요. 그래야 우리가 모두 투자 결정을 내리기 전에 적절하게 정보를 받게 되기 때문이죠. 이런 유형의 약력이 거기에 입력된 것을 여러분들 보지 못하지요, 가치와 기업의 평판을 공유하는 게 다시 말하지만, 위험성을 타진하는 데 중요한데도 불구하고요. 우리가 도덕 지침과 우리나라의 보안 문제를 제쳐 놓는다 해도 이런 것들은 기본 시장 규칙 위반이란 사실이 여전하지요. 우리가 모두 우리의 위험성을 적절하게 밝혀야 하는 마당에서 말입니다. 그런데도 중국인들은 무료 통과권을 얻고 있지요.

보다 최근에 아빅은 이란의 새로운 지상 함대 순항 미사일을 제공했는데 이는 우리가 말하고 있는 지금 미국 해군 6함대뿐 아니라 더한 군사력에 대항하는 데 쓰일 준비가 되어 있을지도 모르지요. 중국의 조선기술에 대해 더 말해본다면 방금 그들은 상업용 선박들을 지었다지요, 맞지요? 글세요, 다시 생각해 보세요, 유도미사일 구축함을 그들이 지었는데 그들이 핵탄두 미사일 잠수함을 짓는다는 것을. 그것들은 우리의 도시들을 목표로 하는 것들이지요. 그것들은 우리의 가족들을 목표로 하는 것들이지요. 그런데 그것들은 이 방에 있는 여러분뿐 아이라 우리 동료 미국인들의 투자 달라로 이득 보고 있는 것들이지요. 이 문제 세상에 알려진 적 있나요?

이것 국회 의사당이나 행정부에서나, 여론에서나 칵테일 파티에서 그 누가  이야기하고 있다고 보세요?  여러분은 누군가가 지금쯤이면 무슨 말을 했을 거라고 생각하겠지만 그런 말 한 사람 없어요, 안 그래요? 지금 저는 경험적인 사실들을 여기서 이야기하는 것이지 미사일 방어 같은 것에 대한 여러분의 의견에 관한 제 의견을 말하는 게 아닙니다. 그러니 이것이야말로 여러분에게 뭔가를 말해줘야겠지요. 그것은 이런 문제에 대해서 우리가 아무것도 알지 못하고 있다는 사실을 알려 주지요 그리고 또한 우리는 중요한 일이긴 하지만 그저 중국과의 무역에만 온 정신을 집중하고 있다는 사실을 알려 주지요. 이거 현금이지요. 이것은 우리가 쏘련과 다퉜던 그 현금이며
한때 우리가 추구했던 것이지요. 우리는 그들의 경화 현금 유통을 추격하였지요. 우리는 그런 금융을 대어주는 서구 정부와 은행들의 탈출 구멍들을 추격했지요. 그들은 아직 작동하고 있을 것이지요. 로날드 레간이 우리가 제공하고 있던 생명 유지관들을 하나하나 막지 않았다면은요.

그런데 짐작 가요 우리 지금 다시 그 일 하는 거예요.. 이제 하익비젼을 말하면서 오늘의 연설을 마치려는데 그거 성공 이야기였을 가능성 많았지요. 이문제 잠시 제한 밖에 있었지요. 인권사회, 공산주의 피해자들 기념 재단에 있는 우리의 친구들과 여러 다른 분들이 오랫동안 이문제를 민감히 주시해 왔지요. .그들은 이들 강제 수용소와 여러분이 우주에서 볼 수 있는 거대한 수의 사람들의 운명을 돕던가 주선하고 있었지요.

그런데 그런 것을 실감나게 설명하기가 어려웠죠. 신중한 대중의 관심을 끌기 어려웠고 행동을 바라기는 더 어려웠지요 그러다 우리는 거기서 돌출구를 찾은거지요. 이제 우리가 중국회사들이 공적으로 거래되는 것을 볼 수 있는 돌출구를. 우리는 우리의 자본시장에 자리잡고 안면 인식 기술 같은 것에 누가 자본을 대는가 알 수 있지요. 철망 뒤에 숨겨진 바로 그 감시 카메라들을 누가 보조하는지도. 이제 이것이 세상에 나와있는데, 공산주의 피해자들과 다른 단체들이 그것을 가능 하게 했지요. 이제 듣자니 아이크비젼은 아마도 상공부의 기업목록을 작성해야 될 모양입니다.상공부는 어떤 부품을 공급하려면 면허를 요구하니까. 제말은 이게 최소한 하이크비젼에 주요 문제가 될 수 있을 거라고 보지요, 하웨이에 무슨 일이 있어난는 가 본다면. 그 이전에 ZTE에 무슨 일이 일어 난는 가 여러분 보았지요. 그래 제 생각에 하이크비젼은 별수 없이 그 기업 목록으로 벽에 부닥치게 될 것이지요.

그들의 모회사가 이미 기업 목록으로 심사받은 적이 있었던 것을 기억하면은. 왜냐면 그들은, 깜짝 놀랍게도. 하나의 국가 보안 사범이니까요. 하이크비젼 같은 경우가 더 있을까요? 우리 이 문제에 확정적인승인을 얻어 낼 수 있을까요? 답은 예, 우리 이를 해 낼수 있는 능력을 갖추고 있어 할 수 있습니다.. 이거 우리들의 돈이고 우리는 월가가 책임 지게 할 권리를 가지고 있지요. 우리는 그리 해야 할 의무를 갖고 있으며, 마침내 우리는 국가안보와 인권 같은 우리의 가장 소중한 가치들을 살려 낼 수 있지요.

우리가 변화를 일으켜야하는 또 다른 지역인

 그 주제에 대해서 이야기 좀 해주시게.

물론 이것은 공개와 책임이란 것에 귀결되지요. 그게 왜 이 경우에 주로 미국이나 서구 유럽 나라 아니 미안 회사에서 이런 구제책이 아주 도움이 될 수 있는 이유지요. 우리 동맹국들 중의 어느 나라든 그들이 뉴욕 증권시장이나 나스닥이나 그 보다 덜한 점두 시장에 등장할 때에는 아주 엄격한 시험을 치러야 하지요.  그런데도 우리는 물질적인 누락을 한 미국 회사는 추적하는 반면에 중국은 이런거 하나도 적어 놓지 않지요.. 공개가 위험 운영과 마찬가지로 기본적이지요 여러분은 기업의 평판에 관해 알려야 할 물질적인 위험을 기록하여야 하지요. 그런데 혹시 그러지 않으면 증권거래위원회는 법적인 행동을 취할 수 있는 물질적인 누락으로 보지요

그러니 그것은 위법이지요. 제 말은 명확히 말하자면 이거 사소한 일이 아니지요. 그런데도 미국회사인 경우에는 물질적인 누락이 있으면 추격하는데 중국은 이런 것 아무것도 적어 넣지 않지요. 그들은 그들이 남중국해에 있다는 것을 알리지 않지요. 그들은 자기네가 북한과 핵미사일 능력을 지원하고 있다는 것을 알리지 않지요. 그들은 그들이 이전에 제재당한 적이 있다는 것을 알리지 않지요. 그들은 그들의 직원이 간첩 일로 체포된 적이 있다는 것도 알리지 않지요. 그것이 위험란 어디에 있지요? 그리고 그런 것은 증권을 매입할것인가 말 것인가 제가 결정하는 데 물질적이 아닌가요?

그들은 제재당할 수 있지요. 당신 들이 우리의
다시말하건애 가치를 젓혀 놓는다해도 그 중권 가치는 어쩌지요? 그들의 기업 평판은 어찌 되지요? 그들이 월가 신문의 첫 페이지나 그런 종류의 어디에 실린다면?

그러니 이것은 실상은 경기장에서도 아이러니한 일로서 이것은 특혜조치지요. 이제 그 아이러니를 생각해봐요. 제 말은 이거 실제로 얼마나 구역 질나는 일인가요.

청중으로부터 질문 하나 더.. 누구?

라져, 무엇이 증권 거래 위원회가 그들의 일을 제대로 하지 못하게 방해하지요?

글쎄요, 일부는 증권 거래 위원회는 여태껏 미국인들 모두에게 명백하게 보이는 그 개념을 대면하도록
도전당하지 않았기 때문이며. 여러분의 배후에 있은 국가 안보 남용의 정도나 여러분의 산화 회사 조직망이 조성해 온 분위기가  어느 정도인가 대면 않고 있었기 때문이지요. 티베트나 위그르족 안에서 일어나고 있는 인권 문제 같은 것은 더 말할 필요도 없고요.

그러니 이런 것들은 물질적인 위험 범주로 인정되지 않았지요.  베이징에는 얼마나 편리했으며 얼마나 좋았겠습니까? 우리가 그것을 그저 잠깐 간과하고 있었으니, 안 그래요?  우리는 부패에 관심 있었고 우리는 또 다른 여러가지에 관심 있었지요. 그러나 이 두 부류는 목표를 달성할 것 같지 않습니다. 그러니 그것이 우리가 바꿀수 있는 것이고 그것이 우리가 지향하는 곳이지요.
